This site is operated by S.C. ALCO ROM S.R.L.
S.C. ALCO ROM S.R.L. is a Romanian legal entity, headquartered in Satu Mare County, Mărtinești nr. 165 C, having the tax registration code 3895180, registered at the Trade Registration Office under No. J30/421/1993, phone: +40 748084878, hereinafter referred to as “DistileriileBran.ro”.
By accessing the site www.distileriilebran.ro, all users expressly agree to abide by the terms and conditions set forth below, as well as comply with the relevant regulations in force, including the terms and conditions of the Privacy Policy, as detailed separately in the sections presented on the site.
Interpretation of the terms
Site – the domain distileriilebran.ro, together with its subdomains and subfolders. This site aims exclusively to present the products and direct customers towards the distributors from whom they can purchase the products.
Bran Distilleries – the trade name of S.C. ALCO ROM S.R.L., a Romanian legal entity, with its registered office in Satu Mare County, Mărtinești nr. 165 C, with the tax registration code 3895180, registered at the Trade Registration Office under No.: J30/421/1993. Bran Distilleries is the Manufacturer of all the Products presented on the Site (alcoholic drinks).
DistileriileBran.ro – online platform meant as a presentation site, owned by S.C. ALCO ROM S.R.L.
User – any person over the legal age of 18, browsing the site www.distileriilebran.ro.
Subscriber – any user who has submitted and completed a newsletter subscription on the site www.distileriilebran.ro.
Applicant – any user who has submitted a request using the contact form on the site www.distileriilebran.ro.
Client – any individual of at least 18 years of age or a legal entity that creates an account on the site of one of the Distributors and places an order that is subsequently confirmed by Bran Distilleries.
Distributor – any legal person that sells the products of S.C. ALCO ROM S.R.L. on the basis of a previously concluded agreement.
Product – any product presented on the corresponding page of www.DistileriileBran.ro. In some cases, minor differences may occur in practice, which are not such as to alter the essential, basic characteristics of the product.
Specifications – all the details of the products uploaded on the site (including, without limitation, the ingredients, image, labels or packaging).
These terms and general conditions of presentation of the Products will be subject to the provisions of Emergency Ordinance No. 34/2014, as well as any other relevant regulation which is effective at the date of access to the site. Where there are several conflicting regulations that govern the same de facto situation, the regulation which is most favourable to the guilty party shall have prevalence over the others.
When the above terms are used on DistileriileBran.ro, they will have the meaning established above. You can easily identify these previously defined terms because they are capitalised. By “we”, we mean the Bran Distilleries.
General Terms and Conditions
By visiting and using the site DistileriileBran.ro, property of SC ALCO ROM SRL, you agree to the terms and conditions below:
The use of the site www.DistileriileBran.ro (navigation, access, purchase of products on this site, personal data processing etc.) implies the User’s guarantee that he/she is at least 18 years of age, so that he/she has the legal right to use alcohol and agrees to the terms and conditions set forth on the site.
DistileriileBran.ro is a presentation site. The products displayed on the site are sold through Distributors, on their own sites, as indicated on the Product pages. Prices may change without prior notice to the Users. Once an order has been placed and confirmed, its final price can no longer change for the Customer who placed the respective order.
The sale price is displayed on the site of the Distributors. It includes all the taxes, except for the courier fee. The sale price can be modified at any time, without prior notice. The Customers will always pay the prices displayed on the site at the moment the order is placed.
The promotions / offers on the Distributors’ sites are valid, within the limits of available stock, within the time interval and under the terms indicated by the Distributors.
Bran Distilleries may refuse to honour an order, or they may cancel it unilaterally, if it was placed by a person who has displayed a hostile attitude / conduct and obvious bad faith towards us.
According to the Romanian law, alcoholic beverages can only be purchased by people who are at least 18 years of age. The delivery of an order that includes alcoholic beverages can be cancelled at any moment if we find by any means, at any time between the placement of an order and its delivery, that the person who ordered the products is a minor.
By using the site / content, the User or Customer is solely responsible for all the activities resulting from its use. Also, he / she is liable for any material, moral, intellectual, electronic damage or otherwise caused to the site or the content of ALCO ROM SRL, in accordance with the applicable Romanian law.
ALCO ROM SRL reserves the right to make any changes to these provisions, as well as any changes to the site DistileriileBran.ro, without prior notice to users in this respect.
ALCO ROM SRL is not responsible for the content, the quality or the nature of the sites accessible through links from DistileriileBran.ro, regardless of the nature of such links. The owners of the respective sites are solely and entirely responsible for the sites in question.
All the products displayed on DistileriileBran.ro are subject to conditions of conformity guarantee, according to the Romanian law and the business policies of the manufacturer and the authorized Distributors.
All the Bran Distilleries products sold by the authorized Distributors indicated on the Site come from sources authorized by SC ALCO ROM SRL.
Any complaint about the failures of the products purchased on the sites of the Distributors can be sent by e-mail at contact@distileriilebran.ro. They will be settled within a reasonable time interval.

ALCO ROM SRL. reserves the full rights to copy and distribute, in whole or in part, the content available on its web pages. Without the owner’s prior consent, it is forbidden to process and exploit the web pages, in whole or in part (text, graphics, photographs, audio or video material, structure etc.).
The Bran Distilleries name and logo are registered trademarks, and therefore subject to copyright. Their use, other than for references, is only possible with the prior and express written consent of their legal owner.
One can borrow content from the web pages of the Site, only if they link back to www.distileriilebran.ro.
Bran Distilleries reserves the right to rewrite or update the content of the pages of the Site or suspend access to them, without prior notice.
ALCO ROM SRL cannot be held responsible for any errors occurring on the site for any reason, including changes, settings, upgrades etc.
The entire content of the site, including texts, images, diagrams, buttons, programs, web graphics, scripts and any other data, is the property of ALCO ROM SRL and it is protected under the Copyright law, as well as the laws regarding the intellectual and industrial property rights. The Resources on the site can only be used to inform the Users and Customers of DistileriileBran.ro. They cannot be used for any other purpose without the prior written consent of SC ALCO ROM SRL. The information may be reproduced in printing exclusively for personal use. It cannot be reproduced, shared or transmitted to another person or otherwise embedded in any document or material.
ALCO ROM SRL guarantees the user limited access to this site, for personal use, and does not grant the user the right to download or change the site, in whole or in part, to reproduce the site, in whole or in part, to copy, sell/resell or exploit the site in any other manner, for commercial purposes or contrary to the interests of ALCO ROM SRL, without the latter’s prior written consent.
The existing photographs and illustrations on the site DistileriileBran.ro cannot be borrowed or used by third parties for any purpose whatsoever, without the prior written consent of SC ALCOROM SRL!
The personal information of the customers can be transferred to relevant authorities to check the commercial transactions or to other relevant authorities to perform any legitimate verification if required under applicable law.
The unrightful use of such information (content) results in legal – civil or criminal – liability. One cannot systematically extract or reuse parts of the site or content, without the written consent of SC ALCOROM SRL.
The Bran Distilleries brand cannot be held responsible for the possible colour differences between what is displayed on the monitor / device of the Customers / Users and the actual product.
By accessing the site DistileriileBran.ro or by sending e-mails to ALCO ROM SRL, the communication is performed electronically, which means that the user agrees to receive notifications from DistileriileBran.ro electronically, including communications by e-mail or by site notifications.
The people who use a false e-mail address or who send electronic messages or any other communications on behalf of another natural or legal person or any other entity, will be sanctioned in accordance with applicable laws.
Abusive use of the site is any use made in bad faith, in a manner that is contrary to standard industry practices, regulations and applicable law, in any other manner that may cause prejudice to DistileriileBran.ro, or for any other purposes than those specific to the normal use of the sight.
Any attempt to access the personal information of another User or Applicant, to modify the content of the Site or to manipulate the performances of the server running the Site will be considered an attempt to defraud the Site or to cause prejudice to SC ALCO ROM SRL, and the competent bodies (including criminal ones) will be notified in this respect.
Fraud and fraud attempts will be punished as provided by the applicable criminal law, and the injured parties may seek moral or pecuniary damages, as the case may be.
Privacy policy
By using, browsing and/or sending a form through the site DistileriileBran.ro, the User agrees to the collecting of the personal information required for sending the replies or for using the site as efficiently as possible.
DistileriileBran.ro fully complies with the Romanian law and the international treaties governing the collection of personal information. The information in the form will only be used to send the replies. Bran Distilleries undertakes not to publish or sell these data.
Users may request at any time the removal of any data collected by Bran Distilleries through its platform. The request will be fulfilled within 10 working days of its registration.

Assignment and subcontracting
Bran Distilleries can assign and/or subcontract a third party for services connected with order processing, by notifying the Customer in this respect. However, the Customer’s consent is not required for the order to be fulfilled.
In case of assignment / subcontracting, DistileriileBran.ro remains liable to the Customer for the manner in which the person to whom the contract was assigned fulfils their obligations towards the Customer.
Disclaimer. Force majeure
SC ALCO ROM SRL cannot warrant that the product description or any other content on the site is either complete or without errors. The images on the site DistileriileBran.ro are for display only, and the actual products delivered may differ from the images in any way, due to changes in features, design, colour etc., without prior notice.
SC ALCO ROM SRL also cannot provide any warranties for the stock availability of the displayed products, which is why the company reserves the right not to deliver – in whole or in part – a specific order placed at the Distributors, if some products are not part of the current offer or if they are not available for other reasons (current shortage of stock, depleted stocks etc.). If the payment is made in advance, the customer will have the right to a full refund of the money paid for the respective product. In all cases where the products cannot be delivered, the customer will be able to request the immediate refund of the money already received by the respective Distributor, without other damages.
The maximum value of SC ALCO ROM SRL’s obligations towards any customer in case of non-delivery or inappropriate delivery is the value of the sums received by SC ALCO ROM SRL from the respective customer. After shipping the products, SC ALCO ROM SRL can no longer be required to refund the money or return the products.
If prices or other product details were inaccurately displayed on the sites of the Distributors, including because of the fact that they were entered incorrectly in the database, Distributors reserve the right to cancel the delivery of the respective product and to notify the customer about the error as soon as possible.
SC ALCO ROM SRL reserves the right to delay or cancel deliveries of the products ordered in case they cannot be performed for reasons beyond our control, such as unfavourable weather conditions, epidemics, protests etc.
Each party has the right to notify the other party of the early termination of the Contract, if within 15 days one of the events described in the previous paragraph does not cease. In such cases, neither party is entitled to claim damages from the other party.
Neither party shall be liable for non-performance of its contractual obligations if such non-performance is due to a force majeure event, as provided by the applicable law.
Governing law. Litigation
This Contract is subject to the Romanian law. Any possible litigation between DistileriileBran.ro and the Customer will be solved amicably, meaning that the dissatisfied party will send a notification to the other party beforehand, through a means of communication that allows for a proof of receipt; in case this is not possible, all litigation will be settled by the competent Romanian courts.
By using the Site, the user agrees that the Romanian law will govern the Terms and Conditions of use stated above, as well as any litigation of any kind that may arise between the user and SC ALCO ROM SRL.
In case of possible disputes between SC ALCO ROM SRL and its customers, one will firstly try to solve them amicably. If amicable settlement is not possible, the dispute will be settled in court in Satu Mare, in accordance with the applicable Romanian law.
Any litigation arising between the Customers, Users or Distributors on the one hand, and Bran Distilleries on the other hand will be settled amicably. In case the litigation cannot be settled amicably, it will be settled by the competent courts.
When in court, the litigations will be settled in accordance with the Romanian law. The territorial jurisdiction of the courts will be determined in relation to the SC ALCO ROM SRL headquarters: Satu Mare County, Mărtinești nr. 165 C.
